“Gave me really good professional advice to help with my family violence case I’m dealing with. Hopefully all goes well”

Official Zay · Google, Aug 10, 2026

“Fired my CA Attorney to hire him due to a lack of communication between me and the CA, none of that was the case between James and I at all, I hired him as a family violence/domestic violence attorney as well as a general criminal defense attorney as he has exceeded expectations.”

After an arrest

What happens next

Bond conditions

Release can come with conditions, such as no contact with the other person or staying away from the home. Follow them until a court changes them.

The charge

Assault on a family or household member is usually a Class A misdemeanor. Impeding breath or a prior family violence conviction can make it a felony.

The plan

We go through the report and the statements with you and prepare the case as if it goes to trial.

In Texas, domestic violence is called family violence.

Bodily injury to a family or household member or a dating partner. Usually a Class A misdemeanor.

Two or more alleged assaults within twelve months. A third degree felony.

Messages or conduct the State says caused fear or alarm. Stalking is a felony, harassment a misdemeanor.

Aggravated assault

An assault with a deadly weapon or serious bodily injury is a felony heard in the district courts.

Questions

Common questions after a domestic violence arrest

Can the charge be dropped if the other person does not want to go forward?

The decision belongs to the State, not to the other person. Their wishes can still matter, so tell us about them in the consultation.

Can I go home after the arrest?

Only if your bond conditions allow it. A condition can bar contact with the other person or keep you away from the home, and breaking it can lead to a new arrest.

What does a conviction mean for my record and my guns?

A family violence finding rules out an order of nondisclosure, and federal law bars gun possession after a family violence conviction.

What does a domestic violence lawyer cost at your firm?

One price, set at the start, covers all legal services for your case, including a trial if there is one. The consultation is free.
