“I cannot recommend James Chiles enough. He handled my serious felony case with professionalism, compassion, and determination from start to finish. This was an incredibly difficult and emotional process, and he made sure I felt heard, supported, and informed every step of the way.”

“He in fact got one of my possession charges dropped already, has been as helpful to both me and my parents (the defendant’s) on my behalf, and just overall has made my first experience with a hired attorney as smooth as I can imagine.”

“These guys are absolutely amazing. My husband was sitting in county for months with no luck of getting out, attorney after attorney, we were losing hope. Then we found James and Patrick.”

“Mr. McGuire is knowledgeable and articulate. His prior work as a prosecutor gives him a deep understanding of what a defendant can encounter in the multiple layers and phases of the judicial system. He listened carefully and was able to give multiple outcome scenarios with recommendations.”

After a felony arrest
A magistrate sets the bond and its conditions. If the amount is out of reach, we can ask the court to lower it.
A felony goes to a Collin County grand jury, which returns an indictment or a no-bill. Work done before that decision matters.
After an indictment the case is heard in a district court at the Russell A. Steindam Courts Building. We prepare it as if it goes to trial.

We explain the charge, the bond conditions and what the court does next.

Charges
The punishment depends on the drug and the amount. Some cases qualify for a drug court or diversion program in Collin County.
Delivery usually carries a higher punishment than possession of the same amount. How the search went and who the informant is can shape the case.
Aggravated assault, burglary of a habitation, arson and unlawful possession of a firearm by a felon are felonies heard in the district courts.
Shoplifting, employee theft, theft of a firearm and organized retail theft. The value taken usually decides whether a theft is a misdemeanor or a felony.

Questions
The grand jury decided not to indict. The felony case does not go forward on that charge.
Possession means the State says the drug was in your care, custody or control. Manufacture or delivery means it says you made, sold or passed it on, and the punishment is usually higher.
